What suppliers miss in New York
- Medicare approval comes first: New York Medicaid will not enroll a DMEPOS provider without site-specific Medicare approval.
- Selling drugs, including prescription items a supplier stocks alongside equipment, still requires a pharmacy, wholesaler or manufacturer registration.
Does New York require a DME supplier license?
New York has no general state license for DME suppliers. The Education Law registers establishments that hold drugs for sale as pharmacies, wholesalers, manufacturers or outsourcing facilities, with no DME category. For Medicaid, suppliers need site-specific Medicare approval and any license their home state requires.
- Product licenses only

Do out-of-state suppliers shipping into New York need a license?
No general DME supplier license applies to out-of-state suppliers. New York Medicaid looks to licensure by the appropriate authority, if one exists, in the state where the supplier is located.
- Out-of-state suppliers not covered
- No New York location required

What does New York Medicaid add for DME suppliers?
Medical and surgical supplies, DME, orthopedic footwear and O&P must come from a DMEPOS provider with site-specific Medicare approval before it applies to Medicaid. The provider must also be licensed or registered where it is located, if that state has such a license. Enrollment for HCPCS codes not active in fee-for-service Medicaid is denied.
