Does Texas require a DME supplier license?
Texas has no general license for DME suppliers. DSHS licenses device manufacturers and distributors, and a distributor is defined as one who moves devices to the person who makes the final sale to the user. A supplier selling to patients is generally outside that license, but drug, oxygen and O&P rules can still apply by product.

Do out-of-state suppliers shipping into Texas need a license?
Device distribution from a place of business outside Texas is exempt from the DSHS distributor license. No general DME supplier license applies to out-of-state suppliers shipping to Texas patients.

What does Texas Medicaid add for DME suppliers?
HHSC may require a surety bond for each enrolled location from provider types with a history or potential of fraud, waste or abuse. The surety must be licensed by the Texas Department of Insurance and hold a Treasury certificate of authority, and no payment is made for any period without a current bond.
